Effective Date: July 14, 2026
This Refund and Cancellation Policy describes how refunds and cancellations work for each category of fee at the physician-owned professional practice serving your state, Omnyx Medical PC in Arizona or Matthew Stapleton, M.D., Professional Corporation in California ("the Practice"). It supplements and is incorporated into the Membership Agreement and Path B Service Agreement.
1. Path A - Membership
1.1 Founding-Rate Deposit ($399)
An optional $399 deposit, paid at omnyxlife.com/join, locks the Founders Circle founding rate. The deposit is fully refundable at any time until membership opens: email refunds@omnyxlife.com and it is returned to the original payment method, no questions asked. When membership opens, the deposit is applied toward the first year of membership (or, on a monthly plan, toward the opening months), or refunded on request instead.
1.2 30-Day Money-Back Guarantee (Founders Circle)
The Founders Circle ($1,997/yr, or $199/mo) is the only membership tier, and is refundable in full within thirty (30) days of the membership Effective Date, subject to the following:
- The refund must be requested in writing to refunds@omnyxlife.com within 30 days of the Effective Date.
- Refund eligibility begins after your initial synchronous video encounter has been scheduled.
- If clinical care has been delivered (initial visit completed, labs ordered, prescriptions issued), the refund is prorated: we deduct the fair-market value of services delivered before issuing the refund.
- Items already purchased and shipped (medications, supplements, lab kits) are non-refundable.
- Labs already collected (whether via an at-home collection device or in person at a national reference laboratory) are non-refundable.
Refunds processed within ten (10) business days of approval. Refunded to the original payment method.
The lifetime-locked founding rate is a pricing benefit and is separate from refundability: choosing Founders Circle does not waive this 30-day guarantee.
1.3 Cancellation of Renewal
You may cancel automatic renewal at any time at least seven (7) days before your renewal date by:
- Using the cancellation flow in the patient portal, OR
- Writing to cancellations@omnyxlife.com
Cancellation of renewal means your membership ends at the end of the current term. You retain access to membership benefits through that date.
1.4 After the 30-Day Guarantee Window
Once the 30-day guarantee window closes, the annual membership fee is non-refundable. You may still cancel future renewals at any time.
2. Path B - Consult/Intake Fees
2.1 If Protocol Is Not Prescribed
If the provider determines that the selected protocol is not clinically appropriate for you and no alternative protocol is mutually agreed:
- The consult/intake fee is refunded, less a $49 administrative fee.
- Refund processed within ten (10) business days.
2.2 If Protocol Is Prescribed
If the protocol is prescribed, the consult/intake fee is non-refundable. If you upgrade to Membership within the 90-day Path B engagement window, the consult/intake fee is credited toward your annual membership fee.
3. Products and Medications
3.1 Shipped Products
Products that have shipped (medications, compounded preparations, supplements) are non-refundable and non-returnable for safety reasons, except where the product was incorrectly fulfilled or damaged in transit.
3.2 Incorrect Fulfillment
If you receive an incorrect product, contact us at orders@omnyxlife.com within seven (7) days of receipt. We will work with the pharmacy partner to remedy.
3.3 Damaged in Transit
If a product is damaged in transit (broken vial, damaged packaging compromising sterility), report immediately. Replacement issued at no charge.
3.4 Cancellation Before Shipment
If you cancel a product order before it has shipped, full refund is issued. For compounded products, "before shipment" means before the compounding pharmacy has begun preparation. Once preparation begins, cancellation may not be possible.
4. Lab Work
Labs already drawn (blood collected) are non-refundable. Lab orders placed but not yet drawn may be canceled by contacting labs@omnyxlife.com; refund issued less any administrative fee charged by the lab partner.
5. Disputed Charges
If you dispute a charge, contact us first at billing@omnyxlife.com. We will work to resolve good-faith disputes within fourteen (14) days. Chargebacks initiated with your card issuer without first attempting to resolve with us may result in account suspension and collection of the disputed amount per the Membership Agreement.
6. Refunds for Service Termination by Us
If we terminate your care for any reason other than your material breach of the Membership Agreement or Path B Service Agreement, we will refund the prorated unused portion of your annual membership fee.
7. Death or Incapacity
In the event of a Member's death or permanent incapacity, the Member's estate or legal representative may request a prorated refund of the unused portion of the annual membership fee. Founders Circle membership is non-transferable.
